Terms of Service
1. Who We Are
NextLevel Launch ("we," "us," "our") is a freelance web design and digital marketing service operated by Eyad Hindiyeh. By hiring us or using our services, you ("Client," "you") agree to these Terms.
2. Services
We provide website design and development, social media management, content creation, Google Business Profile setup, SEO optimization, and brand identity services. The specific scope, deliverables, and timeline for each engagement are agreed upon in writing (email or signed proposal) before work begins.
3. Payment
- One-time projects: A deposit of 50% is due before work begins. The remaining balance is due upon project completion before final files or site access are handed over.
- Monthly retainers: Invoiced at the start of each month. If payment is not received within 7 days, services may be paused until the balance is settled.
- Late payments: Accounts more than 14 days past due may incur a late fee of 5% of the outstanding balance per week.
- All prices are in USD. Payments are non-refundable once work on a phase has begun, except as described in Section 5.
4. Revisions
Each project includes a set number of revision rounds as specified in the proposal. Revisions beyond the included rounds are billed at our current hourly rate. A "revision" means changes to existing work — new features or scope additions are treated as separate work and quoted separately.
5. Cancellations & Refunds
- You may cancel a project at any time. You owe payment for all work completed up to the cancellation date. Deposits are non-refundable.
- For monthly retainers, you may cancel with 14 days' written notice. No partial-month refunds are issued.
- If we fail to deliver agreed work within the stated timeline through our own fault (not due to delays caused by you), we will offer a credit or pro-rated refund at our discretion.
6. Client Responsibilities
You agree to:
- Provide all required content, credentials, and feedback in a timely manner. Project timelines assume reasonable client responsiveness.
- Ensure you have rights to any content (images, copy, logos) you provide to us for use on your site or social accounts.
- Not use our work for any illegal, defamatory, or harmful purpose.
- Keep login credentials and account access secure once handed over.
7. Intellectual Property & Ownership
- Upon receipt of full payment, you own the final delivered website files and creative assets we produced specifically for you.
- We retain the right to display your project in our portfolio and case studies unless you request otherwise in writing.
- Third-party tools, plugins, fonts, or stock assets used in your project remain subject to their own licenses. We will inform you of any ongoing licensing requirements.
- Work not fully paid for remains our property until payment is complete.
8. Hosting & Maintenance
Unless you are on the Website Care Plan, you are responsible for your own hosting, domain renewals, and ongoing maintenance after project handover. We are not liable for downtime, data loss, or security issues that occur after handover unless you have an active Care Plan with us.
9. Limitation of Liability
To the fullest extent permitted by law, NextLevel Launch is not liable for any indirect, incidental, or consequential damages arising from your use of our services, including lost revenue, lost data, or business interruption. Our total liability for any claim is limited to the amount you paid us in the 30 days preceding the claim.
10. Warranties
We warrant that work delivered will conform to the agreed-upon specifications. We do not guarantee specific outcomes such as search rankings, social media growth, or revenue increases, as these depend on many factors outside our control.
11. Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia, United States. Any disputes shall be resolved in the courts of Virginia, and you consent to that jurisdiction.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email or via a notice on this site. Continued use of our services after changes take effect constitutes acceptance.
